Practice Notice: Bondsperson Information

The purpose of this Practice Notice is to set out the information that the Immigration Division expects with regards to:

  • the presentation of bondspersons as an alternative to detention at a detention review hearing
  • requests for an early detention review that propose a bondsperson as an alternative to detention

Presenting an Alternative to Detention

When a detained person is unrepresented and intends to present a bondsperson as an alternative to detention, the Immigration Division will require information on the proposed bondsperson. The following Bondsperson Information form was created to help you provide the information requested at the detention review hearing.

It is also the expectation of the Division for Counsel to be prepared to present the same information at the detention review hearing.

Early Detention Review Requests

It is the expectation of the Immigration Division that requests for an early detention review that propose a bondsperson as an alternative to detention will include the information on the Bondsperson Information form.

Note: Although you are not required to complete the Bondsperson Information sheet, you must be prepared to provide all relevant information as requested on that form. Additional questions may be asked about the proposed bondsperson at the hearing. The Bondsperson Information form does not replace the requirement of the bondsperson to be available to provide testimony at the hearing as directed by the Member.
